In these Terms, “Axlestands.co.uk”, “we”, “us” and “our” mean Mystatic International Limited. “You” and “your” mean the person or business using our website or purchasing from us.

2. About these Terms

These Terms apply to your use of axlestands.co.uk and to orders placed through the website. Please read them before ordering. Our Privacy Policy, Shipping Policy, Returns Policy and Warranty Information also apply where relevant.

Nothing in these Terms limits or removes any rights that consumers have under applicable law, including the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

If you purchase wholly or mainly for purposes relating to your trade, business, craft or profession, you are a business customer. Certain statutory consumer rights referred to in these Terms do not apply to business customers.

3. Using our website

You may use our website only for lawful purposes. You must not:

- misuse the website or knowingly introduce viruses, malware or other harmful material;
- attempt to gain unauthorised access to the website, its server or connected systems;
- use the website fraudulently or submit false or misleading information;
- infringe our intellectual property rights or those of another person; or
- scrape, copy or commercially exploit website content without our written permission, except where permitted by law.

We may restrict or suspend access where reasonably necessary to protect the website, our customers or our business.

4. Products and product information

We take reasonable care to ensure that product descriptions, specifications, photographs, availability and prices are accurate. Images are illustrative, and colours and finishes may vary slightly because of manufacturing processes, lighting and screen settings.

Measurements and load ratings must be checked carefully before purchase. Where a product is safety-critical or requires specialist fitting, it must be selected, installed and used in accordance with its instructions and by a suitably competent person where appropriate. If you are unsure whether a product is suitable, contact us before ordering.

Minor improvements or specification changes may be made by a manufacturer, provided they do not materially reduce the product’s quality, performance or fitness for its stated purpose. We will not substitute a materially different product without your agreement.

5. Prices and payment

Unless clearly stated otherwise, prices shown to consumers include VAT at the applicable rate. Delivery charges and any other applicable costs are displayed before you place your order.

We accept the payment methods displayed at checkout. Payment is processed securely by Shopify and the payment provider you select. We do not normally receive or store your full payment-card details.

If a pricing or product-information error is obvious and could reasonably have been recognised as an error, we may cancel the affected order and refund any amount paid. Otherwise, we will contact you before proceeding.

6. Placing an order and formation of the contract

Placing an order is an offer to buy the products in your basket. An automated order acknowledgement confirms that we have received your order but does not mean that we have accepted it.

A contract is formed when we send confirmation that the order has been dispatched. If we cannot accept your order, we will notify you and refund any payment taken.

We may refuse or cancel an order for legitimate reasons, including:

- a product being unavailable;
- an error in the price or description;
- unsuccessful payment authorisation;
- suspected fraud or misuse;
- delivery being unavailable to the requested address; or
- quantities appearing to be intended for unauthorised resale.

7. Delivery

Delivery options, charges, postcode restrictions and estimated times are set out in our [Shipping Policy](https://axlestands.co.uk/pages/shipping) and are shown at checkout where applicable.

We aim to dispatch in-stock orders within the times stated on the website. Delivery dates are estimates unless we expressly agree a guaranteed date. Events outside our reasonable control, including courier disruption or severe weather, may cause delay.

For consumer orders, unless a different delivery period has been agreed, we will deliver without undue delay and no later than 30 days after the order is placed. If we cannot meet an agreed essential delivery date, or fail to deliver within an additional reasonable period you give us, you may have the right to cancel and receive a refund.

Products become your responsibility when they are delivered into your physical possession or to a person you nominate to receive them. Ownership passes when we have received payment in full.

Please check deliveries promptly and tell us as soon as reasonably possible about missing, damaged or incorrect products. This does not affect your statutory rights.

8. Cancelling an order before dispatch

Contact us promptly if you wish to cancel or amend an order. We will try to accommodate the request, but we cannot guarantee cancellation once an order has entered processing or has been dispatched.

If we cancel an order, we will refund any amount paid for the cancelled products and any related delivery charge that is no longer applicable.

9. Consumer cancellation rights for online purchases

If you are a consumer purchasing online, you normally have a legal right to cancel your order without giving a reason from the time the contract is formed until 14 days after the day on which you, or a person nominated by you, receives the products. Different rules apply where one order is delivered in separate parts; the cancellation period generally runs from receipt of the final item or part.

To cancel, you must give us a clear statement before the cancellation period expires. You may use our [return request form](https://axlestands.co.uk/pages/returns), email sales@axlestands.co.uk, or use the model cancellation form at the end of these Terms.

After cancelling, you must return the products without undue delay and no later than 14 days after telling us that you wish to cancel. Unless the products are faulty, damaged, incorrect or otherwise not in conformity with the contract, you are responsible for the direct cost of returning them. Please contact us before returning long, heavy or oversized products.

We will refund the product price and the cost of our least expensive standard delivery option. We do not have to refund any additional cost paid for enhanced or premium delivery. We may withhold the refund until we receive the products or you provide evidence that they have been sent back, whichever occurs first.

Refunds will be made without undue delay and no later than 14 days after the relevant point described above, using the original payment method unless agreed otherwise.

You may inspect products as you would in a shop. We may reduce a refund to reflect a loss in value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the product.

The statutory right to cancel may not apply to certain products, including goods made to your specifications or clearly personalised, and sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed.

Our voluntary 30-day returns arrangement is explained in our [Returns Policy](https://axlestands.co.uk/pages/returns-policy). It is additional to, and does not replace, your statutory rights.

10. Faulty, damaged, incorrect or misdescribed products

Consumer products must be of satisfactory quality, fit for any purpose made known to us, and match their description. If they do not, you may have statutory rights to reject the products, obtain a repair or replacement, or receive a price reduction or refund, depending on the circumstances and the time that has passed.

Please contact us with your order number and details of the issue. We may ask for photographs or other reasonable information so that we can assess the problem. Where products do not conform to the contract, we will bear reasonable return or collection costs.

11. Change-of-mind returns outside statutory cancellation rights

Any change-of-mind return outside the statutory cancellation period is governed by our voluntary Returns Policy. Products must meet the conditions stated in that policy. This does not limit rights relating to faulty, damaged, incorrect or misdescribed products.

12. Accounts and information you provide

You are responsible for providing accurate and complete contact, billing and delivery information. Please keep account credentials confidential and notify us promptly if you believe your account has been used without permission.

We are not responsible for delivery failure or delay caused by inaccurate information supplied by you, although we will try to help resolve the issue. Additional delivery costs caused by an incorrect address may be charged where lawful and reasonable.

13. Reviews, comments and submitted content

If you submit a review, photograph or other content, it must be accurate, lawful and based on your genuine experience. It must not infringe another person’s rights, contain confidential information, be defamatory, misleading or abusive, or contain malicious code.

You retain ownership of your content but grant us a non-exclusive, royalty-free licence to use, reproduce and display it for operating and promoting our business. We may moderate or remove content where reasonably necessary, including content that breaches these Terms or applicable law.

14. Third-party services and links

Our website may contain links to third-party websites or use services supplied by companies such as Shopify, payment providers and delivery companies. Third parties operate under their own terms and privacy policies.

We are not responsible for third-party websites that we do not control. This does not affect our responsibility for services we appoint to process your order or deliver products to you.

15. Privacy

We process personal information in accordance with our [Privacy Policy](https://axlestands.co.uk/pages/privacy-policy). By using the website or ordering from us, you acknowledge that your information will be processed as described in that policy.

16. Website availability and errors

We aim to keep the website available and accurate but cannot guarantee uninterrupted or error-free access. We may temporarily suspend, withdraw or change parts of the website for maintenance, security or operational reasons.

Nothing in this section allows us to avoid our obligations for an order that we have accepted or our responsibilities under applicable law.

17. Our responsibility for loss or damage

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

- death or personal injury caused by negligence;
- fraud or fraudulent misrepresentation;
- defective products under applicable product-liability law; or
- breach of your statutory rights as a consumer.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill. We are not responsible for loss that was not foreseeable or for business losses arising from a consumer purchase.

If you are a business customer, we will not be liable, to the extent permitted by law, for indirect or consequential loss, loss of profit, revenue, business, anticipated savings, goodwill or data. Nothing in this paragraph excludes liability that cannot lawfully be excluded or restricted.

18. Events outside our reasonable control

We are not responsible for delay or failure caused by an event outside our reasonable control. We will contact you as soon as reasonably possible, take reasonable steps to minimise the effect and explain any material delay. Your statutory rights, including any right to cancel because of serious delay, remain unaffected.

19. Complaints

If you have a complaint, contact us using the details in section 1. We will try to investigate and respond promptly. Please include your order number and enough information for us to understand the issue.

20. Changes to these Terms

We may update these Terms to reflect changes in the law, our products or the way we operate. The Terms applying to an order are those made available when the order was placed, unless a change is required by law or you agree otherwise.

21. General provisions

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

If we delay enforcing a right, that does not waive it. A person who is not a party to the contract has no right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.

These Terms, together with the policies referred to in them and the order confirmation, form the agreement between you and us for the relevant order. Nothing in this section limits liability for fraud or prevents either party from relying on rights that cannot lawfully be excluded.

22. Governing law and courts

These Terms and contracts made through the website are governed by the law of England and Wales.

If you are a consumer living in another part of the United Kingdom, you may also benefit from mandatory local consumer protections and may bring proceedings in the courts of the part of the United Kingdom where you live. Business customers agree that the courts of England and Wales will have exclusive jurisdiction.
